• Article 1: Object of the contract
    These General Terms and Conditions(hereinafter referred to as "GTC") govern the
    sales from the site Fixie Warehouse (hereinafter referred to as the "Site"), and anynatural or legal person visiting
    and/or making a purchase on the Site itself or a third party (hereinafter referred to as"the Client"
    or "You").
    These Terms and Conditions shall apply to the exclusion of all other conditions, unless prior written consent.

    Article 2: Acceptance of Terms
    Anyone placing an order as a private individual on the site claims to be 18 years old and have legal capacity or have parental authorisation allowing him to contract. In the event that these GTC have not been met in accordance with what is stated in this contract and to
    resolve any dispute, Fixie Warehouse reserves the right to apply directly to the tutor or
    legal guardian of that person and require full settlement for all orders contracted.

    Article 3: Formation of the contract
    The information contained on the Site does not constitute an offer in the legal sense of the term, only the order placed between the Client and Fixie Warehouse can constitute an offer.
    The Terms are available to our Clients on the Site. Therefore all orders leads to complete adherence to the terms of the contract without exeption or reservation. These GTC are also communicated to the Client in the process of purchase comfirmation, order entry being subject to their acceptance. Anyone who made a purchase on the Site therefore declare to have full knowledge.

    In case of dispute, the Client and Fixie Warehouse reserve the right, before any legal action to seek an amicable solution. Otherwise, any dispute of any kind whatsoever, will always be within the exclusive jurisdiction of the Commercial Court of Paris, whatever the place of delivery and method of payment accepted.

    After acceptance of the Terms and Conditions, Fixie Warehouse send an e-mail confirmation (hereinafter referred to as "E-mail") of the order to the Customer at the email address that the customer has given when creating their profile or when placing the order.
    This E-mail constitutes acceptance of the customer's order by Fixie Warehouse and thus form the contract of sale.
    These Terms and Conditions govern the contractual relationship between the customer and Fixie Warehouse, both parties accepting them without reservation.

    Article 4: Electronic Signature
    The c ustomer's "double click" when placing the order constitutes an electronic signature that has the same legal value as a handwritten signature between you and the Site.

    Article 5: Proof of the transaction
    The records stored in the information system of the Website will be considered proof of communications, orders and payments with the Client. The filing of purchase orders and invoices is made on a reliable and durable system that can be produced as evidence.

    Article 6: Product Description
    The Customer agrees that the descriptions of the products sold by Fixie Warehouse and described on the
    Site may be subject to change. Effective with the article L 111-1 of the Consumer Code, which provides for the consumer to be able to know the all the attention Fixie Warehouse brings to the description of the products the Customer agrees that
    errors may occur in their descriptions or communication of the price.

    Article 7: Price
    Prices are quoted in Euros and are only valid on the date of the order. The prices indicated on the Site do not include postage and packaging.
    The postage and packaging are calculated according to the delivery location, the size and weight of the products.
    All the orders whatever their origin are payable in Euros.
    Prices displayed in any currency other than the Euro are made from a currency converter
    integrated on the Site, and this for illustrative purposes only. The exchange rate used on the site can
    be different from the exchange rate applied to the Client. We advise the Client to
    contact the institution that issued the card to determine the rate of exchange applicable on the transaction as well as any costs.

    When ordering from a country other than France, the customer is the importer of the product
    concerned. Any customs fees and taxes specific to each country are the responsibility of the Client and/or the recipient, both in terms of declaration and payments to the authorities/agencies in the importing country. Under no circumstances Fixie Warehouse will be responsible for them.
    According to the law in force in the importing country, such taxes, duties etc.. may beclaimed due to the recipient of the order, even if a third person passes the Order. It is therefore the responsibility of the Client to inform beforehand with
    the competent authorities of the importing country, and particularly in the context ofsending a gift.

    Fixie Warehouse reserves the right to modify its prices at any time but we will apply therate in effect at the time of your order.
    No refund can be granted in case of lower price or promotion after the date of your order.

    Orders remain the property of Fixie Warehouse until full payment of the price.
    The price stated in the E-mail confirmation is the final price including all taxes, VAT not applicable, article 293 of the General Tax Code(CGI) for auto-entrepreneurs (micro companies).

    Article 8: Payment

    Fixie Warehouse accepts various types of payements for the Customer to setlle his order. 
    The Customer warrants that Fixie Warehouse has the necessary permissions to use thepayment method selected during the validation of the order.

Fixie Warehouse reserves the right to suspend any order and any delivery in case ofrefusal of authorisation of payment by credit card from the officially accredited bodies or in case of non-payment.
Fixie Warehouse specifically reserves the right to refuse delivery or to honor an order from a consumer who has not fully paid a previous order or with whom a payment dispute is being administered.

Article 9: Availability of products
The order will be executed no later than within three days from the day after the consumer placed his order. In case of unavailability of the ordered product(s), especially because of our suppliers, the consumer will be informed at the earliest and will be able to cancel the order. The consumer will then have the option of requesting either a refund to be paid with 30 days or exchange the product.

However, despite all the precautions Fixie Warehouse takes to have the information as precise as possible as regards to the availability of products, it may be that a product victim of its own succes, was available when the order was placed but unfortunately sold out. Fixie Warehouse will inform its clients as soon as possible if such thing occured. 

If the supply of the missing product could not be guaranteed or exceeded 30
days then Fixie Warehouse reserves the right to cancel its order and reimburse the Customer the price of the missing item within 30 days.

Article 10: Method of Delivery
After confirmation of the order and subject to full payment of products ordered, Fixie Warehouse will ship to the customer the ordered products to the address indicated at the time of order.
For our security and that of our clients, before sending an order Fixie Warehouse reserves the right to ask the Client to provide a proof of ID and o proof of address.
The delivery times quoted on the Website are approximate time frames provided by carriers
with which Fixie Warehouse works. Fixie Warehouse can not be held responsible for the consequences of a delayed delivery due to the carrier especially in case of lost products or strike.
The shippment of goods, is made so at the clients expense and risk and also in case of partial delivery.

Are considered extreme situatiuonss where Fixie Warehouse releases its obligation to deliver, war, riot, fire, strikes, accidents and the impossibility of being supplied.

For reasons of availability of products ordered, an order may be subject to several successive deliveries to the customer.

Article 11: Fault or mistake on the order
In the event that one or more of the products ordered were missing, defective or damaged, the customer or the recipient must make a claim with the carrier at the time of delivery.

To be eligible, these claims must be clear and precise and provide information about thecondition of the goods and not on the packaging ("broken handlebar", "paint damage"and not "damaged parcel", "packaging damaged").

Any claim that requires subsequent verification by the recipient ("subject to control", "subject to unpacking") is not acceptable.

Any claim must be sent to Fixie Warehouse by registered mail with acknowledgment of receipt within 3 working days of delivery of goods.

Any claim made after this time will be rejected

Article 12: Exchanges and Returns
To be accepted, any return must be reported to Fixie Warehouse

In the case of delivery of a product that does not comply with the order placed by the Customer, the Customer has
7 days counted from the date of delivery, to inform Fixie Warehouse of the error and return the product concerned under the conditions described below.
A copy of the invoice and delivery note sent by parcel must always be attached to the product returned.

Any item not in accordance with the Order and subject to a request for return must be returned to
Fixie Warehouse, at the expense of Fixie Warehouse in its original packaging,unopened, worn or damaged.

Shipping costs are the responsibility of Fixie Warehouse, except in cases where it would prove that the product does not match the original declaration made by the consumer in the return claim.

Article 13: Right of withdrawal
According to French law, any person who placed an order on the Site has a period of 7 days to exercise his right of withdrawal, counted from the date of acceptance of the contract of sale, which is the date of validation of the basket and Email.

Only products returned in their original packaging complete and intact and in perfectresale condition will be accepeted. Any product that has been damaged or whoseoriginal packaging has been damaged, will not be refunded or exchanged.

This right of withdrawal is without penalty, except the cost of return. Assuming the exercise of the right of withdrawal, the consumer has the option of requesting either a refund of monies paid, or exchange the product. In the case of an exchange, the re-shipment will be at the expense of the consumer.

In case the claim for the right of withdrawal does not correspond to the conditions defined by this GTC, Fixie Warehouse would be entitled to require full payment of the product(s) ordered.

Article 14: Warranty
Fixie Warehouse is committed to respecting the terms and conditions imposed by themanufacturer's warranty.
Unless otherwise stated, all products offered on the Site are guaranteed for 12 monthsfrom the date of purchase.

This contractual warranty is limited to products subject to normal use and is in addition tothe statutory warranty applied to hidden defects of the product sold.

The warranty takes effect from the date of purchase and for the warranty to be honored a proof of purchase, or
original invoice will be required.

Fixie Warehouse will repair or replace at its discretion, any defective product free of charge. The costs of transportation, handling, and assembly or disassembly are not covered by the warranty.

In this case, it is recalled that the customer must act within a short period of time after finding a defective products and provide proof of the existence of such an anomaly.

The warranty shall lapse if the damage was caused by repairs or work performed on theproduct (s) without the express consent of Fixie Warehouse.

Damage caused by normal wear, accidents, neglect, improper assembly, improper maintenance of the 
products by the customer, as well as the use of parts or devices not consistent with the use originally intended for the product (s) are not covered by this warranty.

Article 15: Responsibility
Fixie Warehouse can not be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or improper use of products sold.
The responsibility of Fixie Warehouse is always limited to the value of the product in question at the date of sale, and with no possibility of appeal to the brand or manufacturer.

Fixie Warehouse or its employee (s) can not be held responsible for direct or indirect damage caused to the Customer or any third party.

As far as the legal conditions allows it, Fixie Warehouse disclaims any liability for any direct and / or indirect that may result from the access or use of the Site or some of its elements, as Fixie Warehouse disclaims any liability arising out of the inability to accessor use it.

Similarly, Fixie Warehouse disclaims all liability for any risks associated with the installation of software that allows the consultation of the Site or for any damages resulting from transmission errors, technical defects, interruptions of communicationsoverload.

The Customer is solely responsible for the delivery of a product. Therefore, the Customermust ensure that the order complies with the legislation of the country of delivery. FixieWarehouse disclaims any liability for consequential damages causedby occurrence due to the purchase of one or more items on the site.

Fixie Warehouse retains ownership of the goods ordered until full payment is receivedThe customer is responsible for the product upon receipt.

, In any case, the responsibility of Fixie Warehouse will not exceed the amount of theorder and can not be blamed for simple errors or omissions that may occur despite allprecautions taken in the presentation of products. In case of difficulties in the implementation of this contract, the client and Fixie Warehouse reserve the right, before any legal action to seek an amicable solution.

Otherwise, the Commercial Court of Paris has exclusive jurisdiction, regardless of theplace of delivery and method of payment accepted.

Article 16: Intellectual Property
All logos, designs, texts, comments, illustrations and images reproduced on the Site as well as intellectual property 

are subject to copyright law worldwide.  Any total or partial reproduction of the Site's content is strictly prohibited without a prior written agreement.

Article 17: Protection of data
Fixie Warehouse is committed to comply with French law 

on the protection of data, in particular at the input, processing and use of personal data.

Customer data will be used exclusively for internal market research
and delivery of goods . Except in juridicial cases were binded by law to release private information,  
the transmission of such data to third parties can not be done. The Customer is in agreement with these
conditions of use of its data.

The Customer at any time, has a right to examine the record of his personal data and may
at any time, request their amendment or withdrawal.

Article 18: Applicable law
These general conditions are subject to French law.

In case of a dispute or a claim, the consumer will apply primarily to FixieWarehouse for an amicable solution.
In case of an appeal, the consumer may file a complaint with theTribunal de Commerce de Paris, whatever the place of delivery and method of payment accepted.

Article 19: Final Provisions
The Customer is authorised to access and use the Site solely for personal use.

In no circomptances and under risks of prosecution, shall its content be used for commercial or any other activity that may be in direct competition with FixieWarehouse.

If one or more conditions hereof are held to be invalid or declared as such under any law, regulation or following a legal decision , it would not affect the application of other terms.

In these Conditions, unless the context otherwise requires words denoting any gendershall be read as including all genders and words importing the singular include the plural and vice versa.

Fixie Warehouse reserves the right to modify at any time these Terms.
